What type of bird is this? ?

Mostly indicated by the birds beak.
A finch would have a beak designed for hulling (aka cracking) seeds.
THIS is a green finch:

You can see the very different structure of the beak compared to your bird's - which is primarily designed for foraging for and catching insects.
In fact, your bird is some type of Warbler.
Looks like it could be an adult (nonbreeding) black throated blue warbler:

Another option (looks slightly less like your bird) is the Pine Warbler.
Either way, this is NOT a finch.
